When you download Solaris 10 from the Oracle website for free, the license says that you can use it for:
If you want to use it in production, you must have a support contract. The 90-day trial was dropped in all circumstances.

Yes, as far as I know, it has been Oraclefied and now costs money. Oracle loves to visit your wallet often.

That depends on your usage, see http://www.oracle.com/technetwork/licenses/solaris-cluster-express-license-167852.html

Your hardware may include a license. Besides the Sun/Oracle hardware, Dell and others sell hardware with Solaris license options. Of course there's always the open source version: http://openindiana.org/ I wouldn't use that for production until there's a stable release. It does seem to work well on my test boxes.
