I’m looking around the web to see if condition below applies to Windows 2008

All my searches have led to this same article http://support.microsoft.com/kb/277867 and nothing related to windows 2008. Before I upgrade client.

I need to know if Windows 2008 will fix this "issue" (which my issue now giving modify permissions w/o delete file and subfolder (special permission), but still have the user be able to save/edit a word/excel file (a must in srv2003 as office rights to a temp file)).

Your question is fairly unclear but I'll try to clarify:

NTFS's Modify permission does not include the "delete subfolders and files" permission. This has not changed in Server 2008 (see here). However, be aware that by default the permission applies to the folder, subfolders, and files. This means that giving a user modify permission to a top level folder WOULD give them the ability to delete subfolders and files because of the inheritance.
