that was it....in AWS RedHat 6.4 Image the default was 0660 for some reason... i changed it and it worked, thx.

@user2196728, yes monit starts the service and the FS is mounted (but with no permission to write files through the web to that partition.

@John, Basically we update the files once we done changing them on a development env. either myself or one of my team...I validated that the NFS has the new changes but the server doesnt recognize it (only new server created by the autoscale will have the changes)

i dont think you can tell the ELB to ping a domain since the default ping is http://<instance_name> then the path...since i have multiple domains on this machine i can't put the domain name, but i will give a try to your configuration!! thx!
