You can add swap if you can't reboot but it won't improve performance. Production servers, especially those running DB servers, shouldn't swap as it kills performance.

Not only will it go up again but the OOM Killer will eventually get invoked (unless it's been disabled) and take down your production service anyway. You need to add more memory and/or carefully manage the memory usage of your application.

Could it be kdmflush is active when you have the high CPU usage? Maybe you need to adjust vm.dirty_* tunables.

I'm no expert on this issue but it appears that even with the setting at 0 it can cause issues (see: rhaas.blogspot.ca/2014/04/…). You haven't said what kind of application you're running but here is an attempt at a solution in the MySQL world (blog.jcole.us/2012/04/16/a-brief-update-on-numa-and-mysql). Let me know if this is on the right track! I'll make it an answer.

No, the data from the client/browser to nginx will be encrypted provided nginx has been configured appropriately. nginx then proxies the requests (unencrypted) to the Apache web servers.
